Timor-Leste to sign ASEAN Extradition Treaty

DILI, 15 October 2025 (TATOLI) – The Council of Ministers has decided to grant full powers to Minister of Justice Sérgio Hornai to sign, on behalf of the State, the Association of Southeast Asian Nations (ASEAN) Extradition Treaty.

The treaty establishes a common legal framework for the extradition of individuals wanted on criminal charges, for trial, or to serve sentences in countries across the region.

The agreement sets out the principles and procedures for the reciprocal surrender of suspects or convicted individuals and identifies the offenses subject to extradition. It also provides clear criteria for accepting or rejecting extradition requests—both mandatory and discretionary—and guarantees due process and humanitarian safeguards in line with international human rights standards.

The measure aims to create a coordinated mechanism to combat transnational criminal networks.

Timor-Leste’s accession to the ASEAN Extradition Treaty is seen as another strategic step toward the country’s full integration into the regional organization.

One of the cases that reignited debate on the absence of a legal framework for extradition was that of Arnolfo Teves. The Filipino politician, accused of murder in his home country, sought political asylum in Timor-Leste. The case dragged on despite an extradition request from the Philippines to the Timorese authorities. Ultimately, Arnolfo Teves was deported to the Philippines in May, where he now faces trial.
